Terms of Sales

Hello and welcome to SA MOWANA!

We look forward to meeting you and taking you on Costa Rica's unique trimaran excursion.

Before booking, we invite you to take a moment to read our terms and conditions.

Excursions and activities are considered confirmed only once the booking is finalized and a confirmation number has been received. If you have any questions regarding your booking, please feel free to contact us at any time; we respond promptly. Tours are confirmed only after payment is made via our booking platform. You may choose to pay the full amount upfront or place a deposit to secure the tour. (Deposits are $300 USD for half-day tours and 30% of the total price for full-day tours.)

Use of imagery and communication (Visual assets)

By entering your information on this webpage, you agree to be contacted directly by a representative of SA MOWANA.

Your information will remain confidential to Mowana Sailing and will not be sold or transferred to any third party.

Your data may be used to contact you after your visit to ensure customer satisfaction.

You may withdraw your consent at any time by sending an email to mowanasailing.com.

Unless otherwise explicitly stated and signed in writing by the Client prior to the start of the service, the Client authorizes the Service Provider to capture images (photographs and/or videos) of the service in progress or the results thereof.

All such visual materials may be used by the Service Provider for promotional, communication, and portfolio purposes across all physical and digital media (including, but not limited to: websites, social media, marketing brochures, and press kits), for a period of 5 years and on a worldwide basis.

The Client warrants to the Service Provider that they hold the necessary image rights authorizations for all identifiable individuals or property present during the service. The Service Provider undertakes to respect the Client's dignity and privacy and agrees not to use the visuals in any context that is defamatory or damaging to the Client's reputation.

Should the Client refuse, they must notify their objection in writing (via email or registered mail) at the time of confirming the quote or order."

Onboard Safety

By booking a Product and/or agreeing to travel with Mowana Sailing, the Client acknowledges that the nature of this type of trip requires adherence to certain safety rules, which will be provided prior to the tour upon arrival on the trimaran MOWANA. The Client agrees to observe and comply with these instructions at all times. Decisions made by the captain or any other member of the Mowana Sailing team regarding the safety and well-being of clients shall prevail in all circumstances. The Client must, at all times, strictly comply with the laws and regulations in force in the countries and regions visited during the trip. If the Client suffers from any condition (medical or otherwise) that could affect their ability to travel or participate in adventure activities, their own enjoyment of the trip, the trip or experience of other participants, or the care that might be required in an emergency, they are required to inform Mowana Sailing at the time of booking. The Client agrees to take all necessary precautions to ensure their own safety during any tour organized by Mowana Sailing. Mowana Sailing accepts no liability in the event of the Client's failure to comply with these provisions.

Refung

Refunds for private tours are available only up to 48 hours before the scheduled start time.

No refunds will be issued after the 48-hour mark.

We have found this policy necessary to ensure we have enough time to make cancelled spots available to others.

No refunds will be granted for "no-shows." All refund requests must be submitted in writing (via email, text, or WhatsApp) and received by our office outside of the 48-hour window preceding the tour. Please note that we do not cancel tours due to rain, and no refunds will be issued based on weather conditions unless sailing is deemed unsafe.

While we do not cancel the activity due to rain, if we determine that weather conditions pose a safety risk, the tour will be cancelled and your booking fully refunded.

If payment is made via our booking platform using PayPal, please be aware that PayPal charges fees. Unless you open a PayPal dispute for a full refund, we can only refund the amount we actually received (the total paid minus PayPal transaction fees). However, PayPal disputes work very well, and we process refunds immediately (or within a maximum of two days).

We are a small family-run business that values our customers highly; we always strive to find solutions and ensure complete customer satisfaction.

Tour Condition

You can easily communicate with our team, who speak fluent English and Spanish.

Please let us know about any issues, even if they seem minor.

Also, please inform us if you have any difficulty swimming or have other concerns. Life jackets are provided on board for both adults and children.

Meals are served on board; please let us know at the time of booking if anyone has any food intolerances so we can adjust the meal accordingly.
